EU Road Freight Damage: How Insurance and Liability Work

Logistics Carriers typically include basic insurance, and some of them allow for purchasing additional coverage at the time of booking.

The following outlines the compensation standards and scope of liability for each carrier:

Kuehne+Nagel: Basic insurance is provided free of charge, with compensation set at €10 per kilogram.

Cargoboard Groupage: Coverage is based on the freight forwarder's liability insurance under the European CMR Convention, with a statutory liability cap of 8.33 SDRs per kilogram. Compensation equals the weight of the damaged goods (in kg) multiplied by €8.33, which represents the maximum payable amount.

Cargoboard Priority: Basic insurance covers loss only (not damage) at €8 per kilogram. For full protection against both loss and damage, you may select the "Insurance" option during booking and declare the cargo's value. This additional insurance covers up to the declared value. Shipments valued over €200,000 must be confirmed with Cargoboard in advance; otherwise, insurance will be void.

FedEx: Compensation is limited to the lowest among repair cost, depreciated value, or replacement cost. You can increase the liability limit by paying an additional Declared Value for Carriage fee when completing the relevant form. The standard limit is $100,000 per shipment (or $50,000 for some freight services). Please note: FedEx does not offer "all-risk" coverage, and declared value claims apply only if FedEx is found legally responsible.

Raben: According to Raben's General Terms & Conditions, Raben is liable for loss, damage, or delay during transit. Compensation for lost or damaged goods is limited to their value at the time of handover, based on market price, invoice value, or the value of similar goods, and shall not exceed statutory limits. For delays caused by Raben, compensation—upon provision of proof—is capped at the relevant transport charges.

It is crucial to note that if an issue arises due to client actions, such as incorrect packaging, wrong information, or loading/unloading delays, the carriers are highly likely to deny the claim, regardless of insurance status.

For loss or damage not attributable to the client, we can assist you in filing a claim upon submission of the required documentation. The claims process generally takes 1 to 3 months. The final decision and compensation amount are determined by carriers’ investigation. If the outcome is unsatisfactory, we can help you appeal the decision.
